PROMOTION RULES FOR CULTURE TRIP’S OUTDOOR EXPERIENCE QUIZ


1. INTRODUCTION

1.1 By entering the promotion, all participants will be deemed to have accepted these terms and conditions in full. All entry instructions form part of these terms and conditions.

1.2 The promotion is open to residents of the UK Ireland, US and New Zealand aged 18 or over at the date on which they enter the promotion, except for employees of the promoter, its group companies, agents or anyone professionally connected with this promotion and any member of their respective immediate families.

1.3 Entry to the promotion opens at 9am on 22nd June 2020 and closes at 11.59pm on 3rd July 2020. No entries received after the closing time will be eligible to win a prize.

1.4 No purchase is necessary to enter the promotion and a purchase will not increase your chances of winning. However, in order to enter the promotion you must have an Internet connection and an email account.

2. HOW TO ENTER THE PROMOTION

2.1 To enter the promotion, participants must input their email address into the following page and subscribe to Culture Trip’s newsletter.

2.2 Only one entry is permitted per person.

3. WINNERS

3.1 One winner will be selected at random from all eligible entries on 6 July 2020.

3.2 Winners will be notified by email through the email address they supplied for the prize promotion and will be asked to confirm their details for delivery of the prize.

4. PRIZES

4.1 There is a total of 1 prize available to be won: the winner will be able to choose an experience or several experiences displayed on Culture Trip’s site worth up to GBP £100 for them and/or a friend. The booking T&Cs shown on the relevant experience page will apply to your participation in the experience.

4.2 Any images are an illustrative example and do not show the exact prize(s).

5. CONDITIONS

5.1 In the event that the promoter is unable to contact a winner within 5 working days of the relevant draw, the promoter reserves the right to award the prize to an alternative winner selected at random in accordance with clause 3.1 of these terms and conditions.

5.2 Prize(s) will be delivered to the winner by email via Culture Trip’s Customer Service team. The prize(s) will be delivered within 30 working days from a valid acceptance of the prize.

5.3 Should the prize be unavailable, a prize of equal or greater value will be substituted. There is no cash alternative available. Prizes are non-transferable and cannot be resold. The promoter reserves the right to substitute an alternative prize of equal or greater value. Unless otherwise agreed in writing by the promoter, the prize will only be awarded to the winner.

5.4 Each winner agrees to participate in reasonable publicity as may be required by the promoter in respect of the promotion. The promoter reserves the right to publish each winner’s name, photograph and county on its website, Facebook page, Instagram page, Linkedin page, subscriber newsletter or Twitter account or to publicise the prize-giving within a year of the closing date.

5.5 The winner’s name and country are available on request by emailing travelsupport@theculturetrip.com within 30 days of the closing date.

5.6 No entries from agents, third parties, syndicated entries or those made using methods such as a computer macro, script or the use of automated devices are permitted and no bulk entries.

5.7 All costs and expenses not included within the prize(s) are the responsibility of the winner(s).

7. PRIVACY

7.1 All personal data submitted in connection with the promotion will be processed by the promoter for the purposes of administering and managing the promotion and prizes (where applicable) and verifying the eligibility of each participant. The promoter is committed to protecting the privacy of all participants. Data that is collected from or about participants will be used in accordance with the promoter’s Privacy Policy, a copy of which can be found at https://theculturetrip.com/privacy-policy/.

8. PROMOTER’S RIGHTS

8.1 The promoter is The Culture Trip Ltd, a company registered in England with company number 97539023, registered office 75 Davies Street, London, W1K 5JN, email legal@theculturetrip.com and VAT registration number 108030463.

8.2 The promoter reserves the right at any time, in its absolute discretion, to:

8.2.1 verify the eligibility of any participant (including their age and place of residence);

8.2.2 disqualify any participant found to be abusing or tampering with the operation of the promotion or entering using fraudulent means, or who the promoter believes to have acted in breach of these terms and conditions; [and]

8.2.3 disqualify participants who do not give correct contact details or those who make an entry on someone else’s behalf; [and

8.2.4 disqualify any participant posting an entry or a comment to the promoter’s Facebook, Instagram, Linkedin and Twitter page that is, in the promoter’s opinion, inappropriate, offensive or upsetting to other participants, fans of the promoter or directly aimed at the promoter, or contrary to applicable law, and to remove any such entry or comment.

8.3 The promoter reserves the right to extend, withdraw, alter or suspend the promotion or these terms and conditions at any time if circumstances beyond its control make this unavoidable.

8.4 Any decision of the promoter in respect of the promotion is final.

9. LIABILITY

9.1 The promotion is not in any way sponsored, endorsed or administered by, or associated with Facebook, Linkedin, Twitter or Instagram. Participants acknowledge that Facebook, Linkedin, Twitter or Instagram shall not have any liability to them in connection with the promotion.

9.2 If the promoter fails to comply with these terms and conditions, the promoter is responsible for loss or damage you suffer that is a foreseeable result of the promoter’s breach of these terms and conditions or its negligence, but it is not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of the promoter’s breach or if they were contemplated by you and the promoter at the time that you entered the promotion.

10. GOVERNING LAW & JURISDICTION

10.1 The promotion and these terms and conditions, and any dispute or claim arising out of or in connection with them, are governed by English law. As a consumer, you will benefit from any mandatory provisions of the law of the country in which you are resident. Nothing in these terms and conditions, including the clause above, affects your rights as a consumer to rely on such mandatory provisions of local law.

10.2You can bring legal proceedings in respect of the promotion and these terms and conditions in the English courts. If you live in Scotland you can bring legal proceedings in respect of the promotion and these terms and conditions in either the Scottish or the English courts. If you live in Northern Ireland you can bring legal proceedings in respect of the promotion and these terms and conditions in either the Northern Irish or the English courts.
