This Terms and Conditions Agreement ("Agreement") is entered into as of 26th Dec.2024, by and between Swastik India Journeys ("Tour Operator") and Culture Trip ("Client"), collectively referred to as the "Parties."
Payment Terms
1.1 Upon confirmation of the booking, Culture Trip agrees to pay 50% of the total tour cost to Swastik India Journeys. 1.2 The remaining balance of the total tour cost must be paid in full no later than 45 days prior to the scheduled departure date of the tour. 1.3 Payments shall be made via bank transfer to the account details provided by Swastik India Journeys. 1.4 Failure to comply with the payment terms may result in the cancellation of the booking and forfeiture of any deposits already paid, subject to the cancellation policy outlined below.
Cancellation Policy
2.1 Cancellation 45 days or more prior to arrival: Swastik India Journeys shall refund 100% of the deposited amount towards the "Tour Cost." 2.2 Cancellation between 45 and 30 days prior to arrival: Swastik India Journeys shall refund 50% of the deposited amount towards the "Tour Cost." 2.3 Cancellation between 30 and 15 days prior to arrival: Swastik India Journeys shall refund 30% of the deposited amount towards the "Tour Cost." 2.4 Cancellation within 15 days prior to arrival: No refund shall be provided. 2.5 Flight Tickets: All flight ticket purchases are non-refundable, irrespective of the cancellation timeline. 2.6 All cancellation requests must be made in writing and acknowledged by Swastik India Journeys to be considered valid.
Responsibilities and Liabilities
3.1 Swastik India Journeys agrees to provide the tour services as per the agreed itinerary, subject to force majeure events or unforeseen circumstances beyond its control. 3.2 Culture Trip agrees to provide accurate traveler details and ensure timely payment as outlined in this Agreement. 3.3 Neither Party shall be liable for any indirect, incidental, or consequential damages arising from the execution or non-execution of this Agreement.
General Terms
4.1 This Agreement constitutes the entire understanding between the Parties concerning its subject matter and supersedes all prior agreements, negotiations, and communications. 4.2 Any amendments to this Agreement must be made in writing and signed by both Parties. 4.3 This Agreement shall be governed by and construed in accordance with the laws of India.
